A Pre-Employment Medical Questionnaire is used to gather relevant health information from a prospective employee where there is a legitimate reason for doing so. It can help an employer understand whether there are health and safety considerations associated with the role and whether workplace adjustments or other support may be appropriate.

The questionnaire is designed to focus on information relevant to the employment and should not be used as a general medical history form or as a means of excluding candidates because of a health condition or disability.

The questionnaire can help identify potential workplace adjustments, role-specific restrictions, Occupational Health requirements and health and safety considerations before employment begins.

It is particularly useful for roles involving specific physical, safety or occupational requirements, although employers should ensure that any questions asked are relevant and proportionate to the purpose for which the information is being collected.

Who should use it?

The template is suitable for HR professionals and employers who need to gather relevant pre-employment health information as part of a lawful and proportionate recruitment or onboarding process.

What happens after the questionnaire is completed?

HR should review the information only for the relevant employment purpose and consider whether further discussion, reasonable adjustments or Occupational Health input is appropriate. The information should not automatically be used to make assumptions about a candidate's ability to perform the role.

Example

An employer is recruiting a machine operator. The role involves operating machinery, standing for extended periods and working in an environment where noise and other workplace hazards are present.

Following a conditional offer, the employer asks the successful candidate to complete a proportionate pre-employment health questionnaire focused on whether they can safely undertake the specific requirements of the role and whether any workplace adjustments may be required.

The candidate discloses a health condition which may affect prolonged standing. Rather than rejecting the candidate, HR discusses the requirements of the role and arranges an Occupational Health assessment to establish whether any reasonable adjustment could enable them to perform the role safely.

The Occupational Health advice identifies a suitable adjustment. The employer considers the recommendation and puts the adjustment in place when the employee starts work.

This template is designed to support the process, but the document should be used alongside the relevant HR procedure and applied to the circumstances of the individual case.

Pre-employment health questions need to be handled carefully because health information is particularly sensitive and discrimination law can apply to decisions made during recruitment. Employers should ensure that any health information requested is relevant, necessary and collected for a legitimate employment purpose.

Health questions before employment

The Equality Act 2010 places restrictions on employers asking job applicants about their health or disability before making an offer of employment, subject to specific exceptions. Employers should therefore consider carefully when the questionnaire is issued and why each question is being asked.

Health questions may be permitted in circumstances such as establishing whether reasonable adjustments are needed for a recruitment assessment, establishing whether an applicant can carry out an intrinsic function of the role, monitoring diversity or taking positive action.

Disability and reasonable adjustments

An employer should not assume that a health condition means that a candidate cannot perform a role. Where a disability is disclosed, the employer should consider whether reasonable adjustments could remove or reduce any disadvantage.

Occupational Health

Occupational Health can help an employer understand functional ability, workplace restrictions and potential adjustments. Where further medical information is required, employers should focus on obtaining information relevant to the employment decision rather than unnecessary medical history.

Health and safety

Employers have duties to protect the health, safety and welfare of employees and others affected by their work. Where a role has specific health and safety requirements, it may be appropriate to establish whether a candidate can safely undertake those requirements, provided the process is handled lawfully and consistently.

Data protection

Health information is special category personal data under UK data protection law. Confidentiality
