What is a less than two years service dismissal confirmation letter?

A less than 2 years service dismissal confirmation letter is used to terminate an employee who worked less than two years. 

It states termination, effective date, reason, final pay, benefits, and company property return.

The letter serves as a record, ensures professionalism, maintains relationships, and protects the company's reputation.

NOTE

For dismissals with an effective date before 1 January 2027, employers should consider the employee's qualifying service and contractual notice period carefully, as the current two-year qualifying period for ordinary unfair dismissal may be relevant. Before making a decision, HR reviews the employee's contract, the concerns raised, any previous feedback or warnings, the reason for dismissal and whether there are any circumstances that could give rise to discrimination, automatically unfair dismissal or other claims.

The employer decides on the appropriate process, holds a meeting with the employee and gives them an opportunity to respond.

Once the decision has been made, the dismissal is confirmed in writing, including the termination date, notice arrangements and final pay information.

  • Ordinary unfair dismissal: For dismissals with an effective date before 1 January 2027, employees will generally need two years' continuous service to bring an ordinary unfair dismissal claim. From 1 January 2027, this qualifying period will reduce to six months.

  • Automatically unfair dismissal: The two-year qualifying period does not apply to automatically unfair reasons for dismissal. Certain reasons can give rise to protection from day one, including whistleblowing, certain family leave rights, trade union activities and health and safety concerns.

  • Discrimination: An employee does not need two years' service to bring a discrimination claim. Employers should therefore ensure that the reason for dismissal is not connected to a protected characteristic.

  • Wrongful dismissal and contractual rights: Length of service does not remove contractual or statutory notice rights. Employers should check the employee's contract and ensure that notice, final pay and accrued holiday are dealt with correctly.

  • Fair procedure: Even where an employee has less than two years' service, following an appropriate process can help identify potential risks and ensure the decision is properly considered. Acas recommends following a fair procedure for dismissals and telling the employee why they have been dismissed, when employment will end and how they can appeal.
