Shared parental leave eligibility checklist

  1. The mother of the child must be eligible for maternity leave or pay or adoption leave or pay.

  2. The mother must give notice to end her maternity leave or pay or adoption leave or pay.

  3. The mother and her partner must be eligible for shared parental leave and pay.

  4. The mother and her partner must have been employed continuously for at least 26 weeks by the end of the 15th week before the expected week of childbirth or adoption.

  5. The mother's partner must still be employed by the same employer at the time of the shared parental leave and pay.

  6. The mother's partner must have been employed continuously by the same employer for at least 26 weeks by the end of the 15th week before the expected week of childbirth or adoption.

  7. The mother's partner must have earned an average of at least £120 per week in the 8 weeks leading up to the 15th week before the expected week of childbirth or adoption.

  8. The mother and her partner must have given their employers the correct notice to take shared parental leave and pay.

  9. Shared parental leave and pay must be taken between the child's birth and first birthday or within 1 year of adoption.
