What is a flexible working request acceptance letter?

Flexible working request acceptance letter template preview

This letter provides a formal written confirmation that an employee’s flexible working request has been accepted. It can be used where the employer agrees to the employee’s requested change in full and provides a clear record of what has been agreed.

Confirming the decision

The letter confirms that the employee’s flexible working request has been accepted and identifies the date on which the new arrangement will begin. This gives both the employee and employer a clear record of the decision.

Recording the new working arrangement

The letter sets out the practical details of the arrangement, such as working hours, working days, start and finish times, or changes to the employee’s normal place of work.

Confirming contractual changes

Where the flexible working arrangement changes the employee’s terms and conditions, the letter provides written confirmation of those changes. This can be retained with the employee’s employment records and contract documentation.

Making the arrangement clear

The letter can clarify expectations around the new working arrangement, including any agreed review period, operational requirements or arrangements that remain unchanged.

Creating a clear employment record

A written acceptance letter helps prevent misunderstandings about what has been agreed and provides a useful record for HR, the employee and their manager. Contractual changes should be recorded in writing within the required timescale.

Example

An employee submits a statutory flexible working request asking to reduce their working week from five days to four days, with Fridays becoming their non-working day. They propose that the change should begin from the start of the following month.

The manager considers the request and confirms that the proposed arrangement can be accommodated without adversely affecting the employee's role or the operation of the team. The employer therefore decides to accept the request in full.

HR sends the employee a written acceptance letter confirming the new working pattern, the effective date and the fact that their contractual working hours will change from that date.

The employee's manager and payroll team are informed of the agreed change, and the employee's contractual and HR records are updated. The organisation also confirms that the remainder of the employee's terms and conditions remain unchanged unless specifically stated otherwise.

HR considerations

UK employment law and best practice

This template is designed to support the process, but the document should be used alongside the relevant HR procedure and applied to the circumstances of the individual case.

Day-one right to request flexible working

Employees have a statutory right to request flexible working from the first day of employment. A statutory request can relate to changes to working hours, working times or place of work. Employees can make up to two statutory requests in any 12-month period, subject to the rules governing live requests.

https://www.gov.uk/flexible-working/applying-for-flexible-working

Accepting a request in full

Where an employer agrees to a statutory flexible working request in full, there is no legal requirement to consult with the employee before making the decision. The employer should nevertheless communicate the decision clearly and confirm the agreed arrangement in writing.

https://www.acas.org.uk/statutory-flexible-working-requests/making-a-decision

Changing the employment contract

If the flexible working arrangement changes the employee's contractual terms, the agreed changes must be put in writing. GOV.UK confirms that where a flexible working request is agreed, the employer must change the terms and conditions in the employee's contract. Acas states that contractual changes should be put in writing within one month of agreeing them.

https://www.acas.org.uk/statutory-flexible-working-requests/communicating-the-decision

Reasonable and fair handling

Employers must handle statutory flexible working requests in a reasonable manner. Although consultation is not required where the request is accepted in full, employers should ensure that the decision is based on the actual request and that employees are not treated less favourably because they have exercised their statutory right to request flexible working.

https://www.acas.org.uk/statutory-flexible-working-requests/considering-a-request

Equality and reasonable adjustments

Flexible working requests must be considered consistently and without unlawful discrimination. Where a flexible working request relates to an employee's disability, the employer must also consider its separate legal obligations regarding reasonable adjustments under the Equality Act 2010.

https://www.gov.uk/reasonable-adjustments-for-disabled-workers

Recording the agreed arrangement

The employer should maintain an accurate record of the agreed flexible working arrangement and ensure that relevant HR, payroll and management records are updated. Written confirmation helps prevent uncertainty about the employee's contractual working pattern.

FAQs

Does an employer have to hold a meeting if it accepts a flexible working request?

No. Where the employer accepts the statutory flexible working request in full, there is no legal requirement to consult with the employee before making the decision. The employer should confirm the decision and agreed arrangement clearly in writing.

Does accepting flexible working change the employee's contract?

It can do. If the agreed arrangement changes contractual terms such as hours, working days or place of work, the change should be confirmed in writing and the employee's contractual records updated.

When should the new flexible working arrangement start?

The start date should be agreed with the employee and clearly stated in the acceptance letter. This gives the employee, manager, payroll and HR a clear date from which the new arrangement applies.

Can an employer review an agreed flexible working arrangement?

Yes. An employer and employee can agree a review or trial arrangement where appropriate. If the arrangement is a permanent contractual change, any subsequent change should be discussed and agreed in accordance with the relevant contractual and legal requirements.

Does accepting flexible working mean every part of the employee's contract changes?

No. The acceptance letter should identify the specific terms that are changing. Unless otherwise stated, the employee's other contractual terms and conditions will normally remain unchanged.
